1. Agreement to Terms

By accessing or using the services provided by SwiftDig, a trading name of Swiftsmart Trading Limited ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.

2. Description of Services

SwiftDig provides web hosting, dedicated servers, cloud computing, storage solutions, and related technical services. The specific features and limitations of each service are described in the relevant service documentation.

3. Account Registration

To use our services, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction
• Provide accurate, complete, and current registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Accept responsibility for all activities under your account

4. Payment Terms

Billing

• All prices are listed in US Dollars (USD) and exclude applicable taxes
• Payment is due upon order placement unless otherwise agreed
• We accept major credit cards, PayPal, and bank transfers
• Recurring services are billed in advance on a monthly or annual basis

Refunds

We offer a 14-day money-back guarantee for new customers on most services. Server Auction purchases and custom configurations are non-refundable. Domain registrations are non-refundable once processed.

5. Service Level Agreement

SwiftDig guarantees 99.9% network uptime for all services. In the event of downtime exceeding our SLA, customers may be eligible for service credits as outlined in our SLA documentation.

6. Acceptable Use

Your use of our services is subject to our Acceptable Use Policy. You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our services.

7. Intellectual Property

The SwiftDig name, logo, and all related trademarks are the property of Swiftsmart Trading Limited. You may not use our intellectual property without prior written consent. You retain all rights to content you upload to our services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIFTDIG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claim arising from these terms or our services shall not exceed the amount paid by you to SwiftDig during the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless SwiftDig, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

10. Termination

Either party may terminate services with 30 days written notice. We may suspend or terminate services immediately for violation of these terms or our Acceptable Use Policy. Upon termination, you must pay all outstanding fees and retrieve your data within 30 days.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Zambia. Any disputes shall be resolved in the competent courts of Lusaka, Zambia.
